These Terms and Conditions govern your access to and use of The Poker Place website, The Poker Place Academy, user accounts, educational materials, quizzes, tools, calculators, visualizers, audio content and any related services made available by us.

The Service is operated by ThePoker-place.com, registration number xxx, with its business address at xxxx, referred to in these Terms as “The Poker Place”, “The Poker Place Academy”, “we”, “us” or “our”.

By visiting the website, creating an account, accessing Academy content, using any tool or purchasing a membership plan, you confirm that you have read, understood and agreed to these Terms.

You may not use the Service if you do not agree to these Terms.

1. AGE RESTRICTION AND ELIGIBILITY

The Service is strictly intended for individuals who are at least 18 years old.

By accessing or using the Service, you represent that:

You are at least 18 years old.
You have the legal capacity to enter into a binding agreement.
Your use of the Service is permitted under the laws applicable to you.
Any poker related activity in which you participate is lawful in your jurisdiction.

We do not knowingly permit individuals under 18 to create an account or access restricted Academy content.

We may request reasonable information to verify eligibility and may suspend or close an account if we reasonably believe that the information provided is inaccurate or that the user does not meet the eligibility requirements.

2. NATURE OF THE SERVICE

The Poker Place Academy provides educational and informational content relating to poker strategy, decision making, mathematical concepts, bankroll management, mental game, player analysis and related subjects.

The Service may include:

Articles and educational guides.
Video and audio lessons.
Quizzes, tests and final examinations.
Preflop charts and strategic reference materials.
Equity, probability, expected value and pot odds tools.
Range, matchup, stack to pot ratio and commitment visualizers.
Bankroll and study tracking tools.
Opponent profiling tools.
Personal dashboards and progress tracking.
Free and premium Academy content.
Links to external services and third party offers.

The Poker Place Academy does not operate poker games, accept wagers, hold player funds or provide gambling accounts.

3. USER ACCOUNTS

Certain content and features require a registered user account.

When creating an account, you agree to provide accurate, current and complete information. You are responsible for keeping your information updated.

Each account is personal and may only be used by the individual who registered it.

You are responsible for:

Keeping your login credentials confidential.
All activity performed through your account.
Using a secure password.
Informing us promptly if you suspect unauthorized access.

You may not sell, transfer, share, lend or provide access to your account to another person.

We may investigate unusual login activity, excessive simultaneous access or other activity that reasonably indicates account sharing, unauthorized access or misuse.

4. MEMBERSHIP PLANS

The Service may offer different membership levels, including a Free Plan and Lifetime Pro.

4.1 Free Plan

The Free Plan may provide access to selected Academy content, quizzes, articles, tools and account features.

The specific content included in the Free Plan may change as the Academy develops.

Registration for a Free Plan does not guarantee permanent access to every feature that was available at the time of registration.

4.2 Lifetime Pro

Lifetime Pro provides access to the premium content and features identified as included in the plan at the time of purchase.

Premium access may include advanced quizzes, final examinations, Academy modules, audio lessons, premium calculators, tracking tools and other features marked as Lifetime Pro.

Unless expressly stated otherwise, Lifetime Pro is a one time purchase and does not automatically renew.

Lifetime Pro is personal, nontransferable and may not be resold or shared.

5. MEANING OF LIFETIME ACCESS

“Lifetime” refers to the operational lifetime of The Poker Place Academy and the continued availability of the relevant Service. It does not refer to the biological lifetime of the purchaser.

Lifetime Pro does not guarantee that:

The website will operate indefinitely.
Every individual feature will remain unchanged forever.
Every future product or service will automatically be included.
Every third party integration will remain available.
Specific tools, lessons, presenters or technologies will remain in their current form.

We may update, replace, reorganize or discontinue individual features for operational, technical, legal, security or educational reasons.

When reasonably possible, we will attempt to avoid materially reducing the core value of an active Lifetime Pro membership.

New standalone products, private coaching, events, software, services or courses may require a separate payment even when a user holds Lifetime Pro, provided this is clearly disclosed before purchase.

6. PRICES AND PAYMENTS

Prices, currencies, taxes and payment terms are displayed during checkout.

By completing a purchase, you authorize our payment provider to charge the selected payment method for the amount shown at checkout.

Payments may be processed by independent payment service providers. We do not normally receive or store complete payment card details.

You are responsible for providing accurate billing information and for ensuring that the selected payment method is valid and authorized.

Access to a paid plan may begin after payment is successfully completed and the plan is activated on the user account.

We may correct obvious pricing, technical or checkout errors. If an error affects a completed purchase, we will contact the purchaser and provide an appropriate resolution in accordance with applicable law.

7. CANCELLATION AND REFUND POLICY

Lifetime Pro purchases include a contractual 30 day cancellation period.

The 30 day period begins when the Lifetime Pro plan is activated on the user account, regardless of the date on which the user first logs in or first accesses premium content.

To request cancellation, the purchaser must contact:

The request should be sent from the email address associated with the account and should include sufficient information to identify the purchase.

A valid cancellation request must be received within 30 calendar days of the activation date.

Accessing or using Academy content during the 30 day period does not, by itself, cancel this contractual cancellation right.

When a refund is approved:

Lifetime Pro access may be removed from the account.
The refund will normally be issued through the original payment method.
Processing times may depend on the payment provider or financial institution.
Promotional credits, bonuses or benefits connected with the refunded purchase may be cancelled.

After the 30 day period, payments are generally nonrefundable, except where a refund is required by applicable law or where we expressly agree otherwise.

We may reject fraudulent, abusive or manipulated refund requests to the extent permitted by law.

Nothing in this section limits any mandatory cancellation, refund or consumer rights that cannot legally be waived.

8. PROMOTIONAL CREDITS AND PARTNER OFFERS

From time to time, The Poker Place Academy may offer promotional credits, membership benefits or other incentives connected with registration through a third party service.

Unless the specific promotion states otherwise, eligibility may require the user to:

Register through the specific tracking link supplied by The Poker Place Academy.
Create a new eligible account with the relevant third party.
Complete any age, identity, location or eligibility verification required by the third party.
Meet the conditions displayed for the promotion.

Registration through another link, an untracked link or an existing unrelated account may not qualify for the promotional credit.

Promotional eligibility may be verified using information received from the third party.

Promotional credits:

Are not cash unless expressly stated otherwise.
Are not transferable between users.
May be subject to verification.
May be cancelled in cases of fraud, duplicate accounts, inaccurate information or failure to meet the promotion conditions.
May also be subject to the independent terms of the relevant third party.

We are not responsible for a third party rejecting or delaying registration, verification, account approval, payment, crediting or service access.

Where separate promotional terms are published, those terms apply in addition to these Terms. In the event of a conflict relating specifically to the promotion, the separate promotional terms will apply.

9. QUIZZES, TESTS AND PROGRESS DATA

The Academy may provide quizzes, module tests, final examinations, scores, achievement indicators and progress tracking.

Quiz results are intended for educational and self assessment purposes only.

They do not constitute:

A professional qualification.
An academic degree.
A license.
A guarantee of poker ability or future performance.
Proof that the user will make profitable decisions in actual play.

Progress data may be stored in the user account, in the user’s browser or through a combination of both, depending on the feature.

Clearing browser data, changing devices, changing accounts, disabling storage technologies or technical updates may affect locally stored progress.

We will make reasonable efforts to maintain account based progress, but we do not guarantee that every score, answer, session or historical record will remain permanently available.

Users may not manipulate test results, automate quiz completion, interfere with scoring systems or attempt to obtain unauthorized access to question banks.

10. TOOLS, CALCULATORS AND VISUALIZERS

The Service may provide poker related calculators, charts, ranges, trackers, visualizers and analytical tools.

Tool results may depend on:

Information entered by the user.
Mathematical assumptions.
Simplified poker models.
Estimated ranges.
Game format and table conditions.
Technical limitations.

Tool outputs are educational estimates and may not represent every possible game state, player tendency, fee structure, rake structure or strategic adjustment.

We do not guarantee that a calculation, range, recommendation, visualization or output is complete, error free or suitable for a specific decision.

You are responsible for reviewing all inputs and determining whether an output is relevant to your situation.

11. EDUCATIONAL PURPOSE AND RISK WARNING

Poker involves uncertainty and may involve substantial financial risk.

All content provided through the Service is intended for educational, informational and entertainment purposes.

Nothing on the Service constitutes:

Financial advice.
Investment advice.
Legal advice.
Tax advice.
A promise or guarantee of profit.
A recommendation to wager or risk money.

Strategies, charts, examples, quizzes and tools cannot guarantee a winning result.

Past results, example hands, simulations and case studies do not guarantee future results.

You are solely responsible for your decisions, participation, bankroll, losses and financial outcomes.

Never play with money that you cannot afford to lose.

If poker or gambling is negatively affecting your finances, health, studies, work or relationships, stop participating and seek assistance from an appropriate professional organization in your jurisdiction.

12. INTELLECTUAL PROPERTY

The Service and its original content, design, branding, features and functionality are owned by or licensed to The Poker Place Academy.

Protected materials may include:

Articles and written lessons.
Videos and audio lessons.
Quizzes, questions, answers and explanations.
Poker charts, ranges and diagrams.
Calculators, visualizers and software.
Graphics, illustrations, logos and icons.
Characters, presenters, personas and avatars.
Page layouts and user interfaces.
Databases and structured educational materials.
Source code and technical systems.

Subject to these Terms, registered users receive a limited, personal, revocable, nonexclusive and nontransferable right to access the content included in their membership plan for personal educational use.

You may not, without our prior written permission:

Copy or redistribute substantial parts of the Service.
Republish Academy materials on another website or platform.
Sell, sublicense or commercially exploit the content.
Record, download or distribute protected video or audio content unless a download feature is expressly provided.
Copy or publish quiz questions or question banks.
Scrape, crawl or extract data using automated systems.
Reverse engineer or attempt to obtain the source code of a protected feature.
Remove copyright, trademark or ownership notices.
Use Academy content to create a competing product, course, database, quiz system or training service.
Use our branding, characters or materials in a way that suggests authorization, sponsorship or affiliation.

13. ACCEPTABLE USE

You agree not to use the Service to:

Violate any applicable law or regulation.
Access another user’s account without permission.
Share paid content with unauthorized users.
Bypass membership restrictions, login requirements, locks or access controls.
Upload malicious code or interfere with the website.
Overload, disrupt or damage our systems.
Collect information about other users without authorization.
Impersonate another person or provide misleading account information.
Harass, threaten or abuse another user or member of our team.
Promote unlawful activity.
Commit fraud or payment abuse.
Use automated tools to reproduce, monitor or extract protected content.
Attempt to discover security vulnerabilities without written authorization.

14. COMMENTS AND USER CONTENT

Some areas of the Service may permit comments, messages, profile information or other user submitted content.

You remain responsible for content you submit.

You confirm that your content:

Is not defamatory, threatening, abusive or unlawfully discriminatory.
Does not contain malware or harmful code.

You grant us a limited, nonexclusive and royalty free license to store, display and process submitted content only as reasonably necessary to operate, moderate and improve the Service.

We may moderate, hide or remove user content that violates these Terms or creates a legal, security or community risk.

15. THIRD PARTY SERVICES AND AFFILIATE DISCLOSURE

The Service may contain links to websites, payment providers, email services, hosting platforms, poker operators or other services owned and operated by third parties.

Some links may be affiliate or tracking links. We may receive a commission, referral fee or other benefit when an eligible user registers, purchases or completes an action through such a link.

The existence of an affiliate relationship does not change your responsibility to review the third party’s terms, privacy policy, eligibility requirements and risk disclosures.

Third party services are not controlled by The Poker Place Academy.

We are not responsible for:

The availability or security of a third party service.
The accuracy of third party information.
Deposits, withdrawals or account balances held by third parties.

Account restrictions, suspensions or closures.
Third party bonuses, credits or promotions.
Losses resulting from activity conducted through a third party.

Poker strategies, educational approaches and software technologies may change over time. Content may therefore be corrected, expanded, replaced or archived.

We are not required to preserve a particular design, tool interface, lesson order or feature indefinitely.

19. ACCOUNT SUSPENSION AND TERMINATION

We may restrict, suspend or terminate an account if we reasonably believe that the user:

Violated these Terms.
Shared or resold account access.
Circumvented access restrictions.
Used stolen or unauthorized payment information.
Engaged in fraud, harassment or unlawful activity.
Attempted to damage or compromise the Service.
Created a security or legal risk.

Where reasonably appropriate, we may provide notice or an opportunity to correct the violation.

Immediate action may be taken where necessary to protect users, payment systems, intellectual property, third parties or the security of the Service.

A user may request account closure by contacting support.

Closing an account does not automatically create a right to a refund outside the applicable cancellation period or mandatory legal rights.

Provisions concerning intellectual property, payment obligations, disclaimers, liability and dispute resolution will continue to apply after account closure where relevant.

20. DISCLAIMER OF WARRANTIES

The Service is provided on an “as available” and “as is” basis, to the maximum extent permitted by law.

We do not guarantee that:

The Service will always be available or free from errors.
Every piece of content will be complete or current.
Every tool output will be accurate.
The Service will meet every user’s individual expectations.
Use of the Service will improve poker results.
The Service will prevent losses.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, The Poker Place Academy and its owners, directors, employees, contractors, partners and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from the use of or inability to use the Service.

This may include loss of profits, poker losses, lost opportunities, lost data, loss of goodwill or business interruption.

We are not responsible for financial losses resulting from decisions made using Academy content, quizzes, calculators, ranges, visualizers or tools.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability for fraud, deliberate misconduct or any liability that cannot legally be limited.

22. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles.

Any dispute relating to the Service or these Terms will be subject to the jurisdiction of the competent courts in Israel, subject to any mandatory consumer protection or jurisdiction rules that apply to the user.

Before beginning formal legal proceedings, the parties are encouraged to contact each other and attempt to resolve the matter in good faith.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or of any other right.

23. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the Service, membership plans, business operations, legal requirements or security practices.

The updated version will be published with a revised “Last Updated” date.

Where a change materially affects an existing paid membership, we may provide additional notice through the website, user account or email.

Changes will not retroactively remove mandatory legal rights or an already approved refund.

Continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms.

24. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

The invalid provision will be interpreted or replaced to the minimum extent necessary to make it lawful and enforceable.

These Terms, together with the Privacy Policy, Cookie Policy, checkout disclosures and any specific promotional terms, form the agreement between the user and The Poker Place Academy concerning the Service.
